Website Care Plan Terms

These Website Care Plan Terms govern the recurring website maintenance and support services provided by Chezmaxo.

By purchasing or continuing to use a Website Care Plan, the client agrees to these terms, together with any applicable proposal, service agreement or statement of work provided by Chezmaxo.

1. Plans Covered

These terms apply to the following Website Care Plans:

  • Starter Care — $25 per month
  • Monthly Support — $50 per month
  • Business Care — $100 per month

All prices are in Canadian dollars unless otherwise stated. Applicable taxes may be added where required.

Each plan covers only the services specifically listed below. Website development, redesigns and larger upgrades are separate services.

2. Services Included

Starter Care — $25 per month

Starter Care includes:

  • Email support
  • Minor technical fixes
  • Up to 30 minutes of website work per month
  • Standard response and turnaround time

Unused time does not accumulate and does not roll over to a future billing period.

Monthly Support — $50 per month

Monthly Support includes everything in Starter Care, plus:

  • Up to 1 hour 15 minutes of website work per month
  • Content and image replacements within the existing website layout
  • Typical turnaround within three to five business days

Business Care — $100 per month

Business Care includes everything in Monthly Support, plus:

  • Up to 3 hours of website work per month
  • Priority support
  • Typical turnaround within one to three business days
  • Minor adjustments to existing layouts
  • More frequent content updates within the monthly time allowance
  • Basic website performance reviews

Business Care does not include emergency, after-hours or guaranteed same-day support unless separately agreed to in writing.

3. Meaning of Website Work

Included website work is measured using the actual time reasonably required to review, prepare, complete, test and communicate about a request.

A request may use the client's full monthly allowance even when the visible change appears small, particularly when the request requires troubleshooting, image preparation, mobile testing, third-party coordination or correction of conflicting website code.

Chezmaxo will inform the client when a request is expected to exceed the included allowance.

Related requests submitted separately may be grouped and treated as one request. Time spent reviewing messages, obtaining clarification, preparing content, performing the change, testing and communicating about the request counts toward the plan allowance.

4. Services Not Included

Website Care Plans do not include:

  • New booking or appointment systems
  • New payment systems
  • Online-store development
  • Custom forms or advanced form logic
  • Membership or login systems
  • Customer portals
  • Custom applications or advanced functionality
  • Large content-writing projects
  • Product or service data entry
  • Professional photography or graphic design
  • Major search-engine optimization work
  • Advertising or social-media management
  • Domain registration fees
  • Website hosting fees, unless specifically included in writing
  • Premium themes, plugins, licences or subscriptions
  • Repairs required because of changes made by the client or another service provider
  • Malware removal or cybersecurity incident recovery, unless separately agreed
  • Work on services or systems not controlled by Chezmaxo

These services are considered additional work and will be quoted separately.

As an exception, Chezmaxo may choose to accept a new website page or a complete section redesign as part of an active Care Plan, at its sole discretion and depending on current workload. These requests are not subject to the turnaround times in Section 6 and may take up to one to three months to complete.

A full website redesign may also be accepted under the same discretionary basis, but given its significantly larger scope, it may take considerably longer — typically three to six months, depending on current workload.

In either case, Chezmaxo may instead offer a separately-quoted, faster timeline if the client prefers not to wait. Chezmaxo is never obligated to accept these requests under a Care Plan and may direct the client to request a separate quote at any time.

5. Submitting Requests

Support and update requests should be submitted through the client portal. This is the preferred method and allows Chezmaxo to track and prioritize requests accurately.

Email is also accepted and may be more convenient for requests involving large attachments or files. Requests may be sent to:

Requests should include:

  • A clear description of the requested change
  • The page or section affected
  • Final text, images or other content to be used
  • Any relevant login, account or reference information

Turnaround time begins after Chezmaxo has received all required information, content, approvals and access.

Multiple changes submitted together may be treated as one larger request and may exceed the client's included monthly allowance.

6. Response and Turnaround Times

Response time means the time in which Chezmaxo normally acknowledges or reviews a request. Turnaround time means the estimated period required to complete eligible work after all content, information and access have been received.

The following turnaround times are service targets and not guarantees:

  • Starter Care: typically within five business days
  • Monthly Support: typically within three to five business days
  • Business Care: typically within one to three business days

Business days exclude weekends, statutory holidays, and announced business closures.

Turnaround times may be affected by:

  • The size or complexity of the request
  • Missing information or content
  • Delayed client responses
  • Third-party service issues
  • Hosting or domain-provider outages
  • Emergencies or unusually high request volumes

Priority support means that Business Care requests are normally reviewed ahead of non-priority requests. It does not guarantee immediate or same-day completion.

7. Monthly Support Limits

Each plan includes only the update frequency or work allowance stated in Section 2.

When a request exceeds the client's available allowance, the client may choose to:

  • Receive a separate quote for the additional work;
  • Authorize additional work at Chezmaxo's current hourly rate; or
  • Postpone eligible work until a future billing period.

Work will not be postponed automatically. Chezmaxo and the client must agree on how the additional request will be handled.

Urgent work may require an additional fee and remains subject to availability.

8. No Rollover

Unused updates, minutes or support allowances do not carry over to future billing periods.

Each allowance expires at the end of the billing period in which it was provided.

9. Additional-Work Approval

Work outside the client's plan will be described and priced before it begins.

The client's written approval by email, electronic message, signed quotation or accepted invoice is sufficient authorization to proceed.

Chezmaxo will not intentionally charge the client for additional work without prior approval.

10. Client-Owned Hosting and Third-Party Services

The client is responsible for purchasing, owning, renewing and paying for all third-party products and services required for their website.

These services may include:

  • Website hosting
  • Domain-name registration and renewal
  • Business email hosting
  • Premium themes or plugins
  • Software licences
  • Booking platforms
  • Payment-processing services
  • E-commerce services
  • Security or backup services
  • Stock photographs
  • Other external subscriptions or integrations

Whenever possible, all third-party accounts must be created using the client's legal name, business information, email address and payment method.

Chezmaxo may recommend suitable providers and assist the client with setup, but Chezmaxo will not normally purchase, own or maintain payment responsibility for these services.

The client remains responsible for:

  • Keeping payment information current
  • Paying renewal charges
  • Reviewing third-party pricing and terms
  • Maintaining access to their accounts
  • Cancelling services they no longer require
  • Responding to notices from third-party providers

Chezmaxo is not responsible for a website, domain, email account or other service being suspended because of an expired payment method, missed payment, cancelled subscription or failure by the client to renew a service.

Third-party providers may change their prices, features, policies or availability at any time. Chezmaxo is not responsible for these changes.

11. Website and Account Access

The client agrees to provide Chezmaxo with the access reasonably required to build, monitor, maintain and update the website.

Whenever the service provider supports it, the client should provide Chezmaxo with a separate administrator, collaborator, developer or delegated-access account.

The client should not provide Chezmaxo with access to the client's personal payment information unless it is absolutely necessary for an authorized task.

Access may be required for:

  • The website-hosting account
  • The website content-management system
  • Domain and DNS settings
  • Website databases
  • Analytics services
  • Plugins and integrations
  • Booking or payment platforms
  • Other website-related services

The client remains the owner and primary account holder of these services.

Chezmaxo will use the provided access only for authorized website work and will take reasonable measures to protect account credentials.

The client must notify Chezmaxo when passwords, permissions or account settings are changed in a way that could affect the services.

The client may remove Chezmaxo's access after the service relationship ends, provided that all outstanding work and account-transfer responsibilities have been completed.

12. Hosting and Domain Responsibility

Website hosting and domain registration are not included in the monthly Website Care Plan price unless explicitly stated otherwise in writing.

The client is responsible for selecting and purchasing an appropriate hosting plan and domain name.

Chezmaxo may:

  • Recommend a hosting provider
  • Help the client choose an appropriate plan
  • Assist with the initial setup
  • Connect the domain to the website
  • Configure basic website settings
  • Communicate with the provider when technical assistance is needed

However, the hosting and domain accounts will remain under the client's ownership and payment responsibility.

Chezmaxo does not guarantee the performance, security, availability or continued operation of any third-party hosting or domain provider.

Assistance involving a third-party provider is limited to reasonable troubleshooting and communication. Chezmaxo cannot guarantee that the provider will resolve an issue or respond within a particular time.

13. Billing and Payment

Care Plans are payable monthly or yearly in advance, depending on the billing cycle selected by the client.

Chezmaxo does not store payment information or charge the client automatically. The client completes payment manually each billing period through the client portal, using PayPal, Zelle or Interac e-Transfer.

Payment is due on the invoice date unless another due date is shown on the invoice or agreed to in writing.

If payment is not received for a billing period, Chezmaxo may pause new update and support requests or suspend Care Plan services, as described in Section 14.

14. Cancellation

Care Plans operate on a month-to-month basis unless a different term is stated in the client's service agreement.

The client may request cancellation at any time by written notice to chezmaxo@outlook.com. Unless an earlier effective date is required by applicable law or agreed to by Chezmaxo, cancellation will take effect at the end of the current paid billing period.

The client will continue to receive the plan's regular services until the effective cancellation date, provided the account remains in good standing.

Amounts paid will be applied to services already provided, work completed, time reasonably reserved and approved expenses incurred. Any refund or outstanding balance will be determined under the applicable agreement and mandatory law.

Cancellation of a Care Plan does not automatically cancel third-party products or subscriptions owned or billed directly to the client. The client remains responsible for cancelling those services.

Chezmaxo's Right to Suspend or End a Care Plan

Chezmaxo may immediately suspend services where reasonably necessary because of:

  • Non-payment
  • Security risks
  • Illegal requests
  • Abusive behaviour
  • Missing required access

In other circumstances, Chezmaxo will provide reasonable written notice before ending an active Care Plan, subject to any notice period required by applicable law.

The client remains responsible for approved work and third-party costs incurred before suspension or cancellation.

15. Client Responsibilities

The client is responsible for:

  • Providing accurate and complete instructions
  • Supplying final and legally usable text, images and other content
  • Responding to questions and approval requests within a reasonable time
  • Maintaining valid billing information
  • Providing the required website and account access
  • Reviewing completed changes and reporting concerns promptly
  • Maintaining appropriate rights or licences for submitted content
  • Keeping independent copies of important business content and records
  • Informing Chezmaxo of changes made by the client or another service provider

Chezmaxo is not responsible for delays, errors or additional work caused by incomplete instructions, missing access, inaccurate content or unauthorized third-party changes.

16. Backups

Website backups are the responsibility of the client's hosting provider. Chezmaxo does not create, perform or verify backups, and backup availability depends entirely on the features included in the client's hosting plan.

Unless otherwise agreed in writing:

  • Chezmaxo does not guarantee that backups exist, are current or are recoverable;
  • Backup availability depends entirely on the client's hosting provider and selected hosting plan;
  • Care Plan services are not a substitute for the client's own record-retention practices.

If restoration is ever needed, Chezmaxo will make reasonable efforts to assist the client in locating and using a backup through the hosting provider's own tools, where available. This assistance is not a guarantee of a successful outcome, and significant restoration or recovery work may be quoted separately.

Clients who want stronger backup guarantees should choose a hosting plan that includes automated backups, or ask Chezmaxo to recommend one.

17. Monitoring and Technical Fixes

Chezmaxo does not run automated or continuous monitoring of client websites. Chezmaxo becomes aware of a technical problem when the client reports it, or, occasionally, when Chezmaxo happens to notice it while working on the site for another reason.

Clients who want proactive uptime monitoring should use a dedicated monitoring service; Chezmaxo can recommend one on request.

A minor technical fix is a limited correction to existing website functionality that can reasonably be completed within the plan's available time.

Minor technical fixes generally cover small issues affecting an existing Chezmaxo-supported website.

They do not include:

  • Rebuilding damaged website sections
  • Repairing unsupported or abandoned software
  • Malware removal
  • Recovery from hacking or data loss
  • Server administration
  • Problems caused by client changes
  • Problems caused by another developer or provider
  • Major compatibility or software-upgrade projects

Chezmaxo will advise the client when an issue falls outside the Care Plan.

18. Third-Party Interruptions

Chezmaxo is not responsible for outages, interruptions, data loss, security incidents or service changes caused by third parties outside its reasonable control.

This includes issues involving:

  • Hosting companies
  • Domain registrars
  • Internet providers
  • Email providers
  • Payment processors
  • Plugin developers
  • Software platforms
  • Content-delivery networks
  • External APIs or integrations

Chezmaxo will make reasonable efforts to assist the client in identifying or communicating about such issues. Additional recovery, migration or repair work may be quoted separately.

19. Website Ownership

Website ownership, source-code ownership and licensing terms are governed by the client's website-development agreement, proposal or other written service agreement.

Payment for a Website Care Plan does not transfer ownership of third-party software, themes, plugins, fonts, photographs, subscriptions or other licensed materials.

Unless otherwise agreed in writing, cancelling a Care Plan does not remove the client's ownership rights in content or deliverables that were previously transferred to the client.

20. Acceptable Use

Care Plans may not be used to request or support:

  • Illegal activity or illegal content
  • Fraudulent or deceptive activity
  • Intellectual-property infringement
  • Harassment, threats or abuse
  • Malicious software
  • Unauthorized access to systems or data
  • Content or activity that violates third-party rights
  • Work outside the normal scope of small-business website maintenance

Chezmaxo may refuse or discontinue a request that it reasonably believes violates these rules or applicable law.

21. Confidentiality and Privacy

Chezmaxo may receive access to confidential business information and website-account information while providing services.

Chezmaxo will use such information only as reasonably necessary to provide the requested services, administer the client relationship, process payments and comply with legal obligations.

Chezmaxo maintains reasonable safeguards to protect confidential information and account credentials in its possession, and will remove access to client accounts once it is no longer needed for the services.

The client should avoid sending passwords or sensitive personal information through insecure communication methods.

The collection and handling of personal information are also governed by the Chezmaxo Privacy Policy.

22. Limitation of Service

Website Care Plans are maintenance and support services. They are not guarantees that a website will:

  • Operate without interruption or error
  • Be protected from every security threat
  • Achieve a particular search-engine position
  • Produce a particular number of visitors, leads or sales
  • Remain compatible with every future browser, device or third-party service

Chezmaxo will provide the services with reasonable care but cannot guarantee outcomes controlled by visitors, search engines, external providers or other third parties.

Nothing in these terms excludes any right, warranty or remedy that cannot legally be excluded.

23. Changes to Plans, Prices or Terms

Chezmaxo may update these terms, plan features or pricing when reasonably necessary.

For material changes affecting an active client's price or included services, Chezmaxo will provide written notice before the change takes effect.

The notice will state:

  • The nature of the change
  • The effective date
  • Any action required from the client
  • The client's available cancellation options

Changes will not apply retroactively to services already paid for unless required by law or agreed to by the client.

Continued use of the Care Plan after the effective date may indicate acceptance of the updated terms, subject to applicable law.

24. Relationship With Other Agreements

If these terms conflict with a signed service agreement, accepted proposal or statement of work, the following order of priority applies:

  • The signed service agreement
  • The accepted proposal or statement of work
  • These Website Care Plan Terms
  • General website information or marketing materials

25. Governing Law

These terms are governed by the laws of Canada and the laws of the province in which Chezmaxo operates, as applicable.

Nothing in these terms limits any mandatory rights available under applicable law.
